What are my legal options and how do I get my security deposit back and from a large real estate company?
It has been 34 days and I have not received my security deposit back that they said I would get back in full. They told me it was mailed over 10 days ago, which appears to be a lie or it got lost in the mail. I want them to cancel the check and send a new one via Fed Ex immediately but they won't answer or return my calls. I live in a town where by law the landlord is given 21 days to pay you or show receipts for work paid for in lieu of the deposit. What are my options besides continuing to hound them? How do I go about exercising those options? How much leeway should I give them? Can I legally put a lien on THEM or send them to collections as an individual against a giant?
Send a certified letter telling them that you expect payment within 5 days or you will take them to small claims court AND that you will seek damages and interest. It will get their attention. If they don't respond, then do just that. Filing will cost around $40-$80 but when the judge finds in your favor, that amount will be recoverable.
